What Else You Should Know

  • A link to another account may be a less expensive option than overdraft privilege. A single larger overdraft will result in just one fee, as opposed to multiple smaller overdrafts. Good account management is the best way to avoid overdrafts. Use our mobile banking, internet banking, and telephone banking services to keep track of your balance. For additional financial education resources, please visit www.mymoney.gov.
  • The $30.00 Courtesy Pay Fee that is charged if you overdraw your account more than $5.00 is the same fee amount that is charged if an overdraft item is returned as unpaid. We do not charge a fee if your account is overdrawn by $5.00 or less, provided you are enrolled in and eligible for either Standard Coverage or Extended Coverage on your account at the time of the overdraft. If multiple items overdraw your account on the same day, up to four (4) items per share, per day will be assessed an appropriate Courtesy Pay Fee or NSF Fee – Unpaid of $30.00. All fees and charges will reduce your available Overdraft Privilege. Your account may become overdrawn more than the Overdraft Privilege limit amount because of a fee. However, after that occurrence, items will be returned unpaid, and an NSF fee will be charged. That fee will also be deducted from your available overdraft limits.
  • If an item is returned because the Available Balance (as defined below) in your account is not sufficient to cover the item and the item is presented for payment again, Members First will charge an NSF Fee - Unpaid each time it returns the item because it exceeds the available balance in your account. When we charge an NSF Fee - Unpaid, the charge reduces the Available Balance in your account and may put your account into (or further into) overdraft. If, on re-presentment of the item, the available balance is sufficient to cover the item (includes your Overdraft Privilege Limit as defined below), and Members First uses the Overdraft Privilege Limit to pay the item, the payment will result in a Courtesy Pay Fee.
  • Overdraft Fee charges, are limited to four (4) per share, per day.
  • The following describes the posting order for purposes of determining your available balance (the following is deducted from your available balance when the file is received by the Credit Union.

ACH Transaction are processed four (4) times per day at approximately 5:00 am, 12:30 pm, 3:30 pm. and                5:20 pm. Each file posts in the following order:

  1. ACH Settlement Day (In accordance with NACHA Rules)
  2. ACH Credits
  3. ACH Debits
  4. All remaining items lowest to highest
  5. Drafts (Cash Letters) post lowest to highest
  • Although under payment system rules, Members First may be obligated to pay some unauthorized debit card transactions, Members First will not authorize debit card or ATM transactions unless your account’s available balance (including Overdraft Coverage Options) is sufficient to cover the transaction(s).
  • Giving us your consent to pay everyday debit card and ATM overdrafts on your account (Extended Coverage) may result in you incurring Courtesy Pay Fees for transactions that we would otherwise be required to pay without assessing a fee. However, this would allow us to authorize transactions up to the amount of your Overdraft Privilege limit and may also help you avoid overdrafts in excess of your available balance that could result in suspension of your debit card. If you consent to Extended Coverage on your account, it will remain on your account until it is otherwise withdrawn by you or Members First.
  • Depositor and each Authorized Signatory will continue to be liable, jointly, and severally, for all overdraft and fee amounts, as described in the Membership Agreement & Disclosure. The total (negative) balance, including all fees and charges, is due and payable upon demand.
  • Overdraft Privilege is not a line of credit; it is a discretionary overdraft service that can be withdrawn at any time without prior notice.

Understanding your Available Balance:

  • Members First authorizes and pays transactions using the available balance in your account. Members First Credit Union may place a hold on deposited funds in accordance with our Membership Agreement and Disclosure, which will reduce the amount in your available balance.
  • Your available balance is the calculation of the amount of money in your account:
  • minus any credits or debits that have not fully posted to the account yet
  • minus any account holds such as check holds and/or pending debit card transactions
  • plus any Overdraft Protection as well as any available Overdraft Privilege.

Standard Coverage uses your available balance to clear checks, ACH items, recurring debit card transactions, Online Bill Pay items, Internet Banking Transfers, Telephone Banking, and teller window transactions. Extended Coverage uses your available balance to clear all Standard Coverage items plus ATM Transactions and Everyday Debit Card Transactions.

  • Members First’s determination of an insufficient available account balance may be made at any time between presentation and the Credit Union’s midnight deadline with only one review of the account required. You will be notified if your account does not have sufficient available funds to pay an overdraft.
  • Please be aware that the Overdraft Privilege amount is not included in your available balance provided through online banking, mobile banking, or ATMs.
  • Members First will place a hold on your account for any authorized debit card transaction until the transaction settles (usually within two business days) or as permitted by the payment system rules. In some cases, the hold may exceed the amount of the transaction. When the hold ends, the funds will be added to the available balance in your account. If your account is overdrawn after the held funds are added to the available balance and the transaction is posted to the available balance, an NSF Paid Fee or NSF Unpaid Fee may be assessed.
  • Because your Available Balance reflects pending transactions and debit holds, your Current Balance may appear to cover a transaction but later upon settlement it may not be sufficient to cover the transaction. In such cases, where a transaction was approved with a positive Available Balance, but settlement occurs against a negative Available Balance, the transaction may further overdraw your account but would not be subject to additional overdraft fees. You should assume that any item which would overdraw your account based on your Available Balance may create an overdraft.
  • Except as described herein, Members First will not pay items if the available balance in your account (including the Overdraft Privilege limit, if applicable) is not sufficient to cover the item(s).

Understanding Debit Card Privileges

  • Members First may suspend your debit card if you incur overdrafts in excess of the available balance in your account, including any Overdraft Privilege limit (as described herein). Debit cards on your account will remain suspended until you make sufficient deposits so that your available balance, taking into account any Overdraft Privilege limit, is positive for one business day and then you contact us.
  • Members First may also suspend your debit card if your account is overdrawn more than thirty-two (32) consecutive calendar days. Debit cards on your account will remain suspended until you make sufficient deposits so that your account balance is positive for one business day and then you contact us.
  • Members First may also suspend your debit card if we are unable to contact you due to an incorrect mailing address or phone number(s). You must contact us with your correct mailing address and/or phone number(s) to have your debit card reinstated.
  • If your debit card is suspended, you will be unable to use your debit card for purchases or to access your account at the ATM, and if you use your debit card for recurring payments, e.g. utilities, you are responsible to make other arrangements for your recurring debit payment(s).

Understanding Overdraft Privilege Limits

  • An Overdraft Privilege Limit of $750 may be granted to eligible checking accounts opened at least 60 days in good standing. A review of activity will be conducted just before the 60-day mark, and if the account has not been maintained satisfactorily, including an average balance of $750, the privilege may not be extended. You will be notified if this delay is applied.
  • Overdraft Privilege may be reduced if you default on any loan or other obligation to us, your account becomes subject to any legal or administrative order or levy, or if you fail to maintain your account in good standing by not bringing your account to a positive balance within thirty-two (32) days for a minimum of one business day.
  • Overdraft Privilege may be suspended or permanently revoked during an extended repayment plan or due to excessive use of and or/default of an extended repayment plan(s); we may also suspend the limit if your direct deposit is cancelled while your account is overdrawn thirty-two (32) days or more or during an extended repayment plan. You must bring your account balance positive for at least one business day, or complete the terms of your extended repayment plan in full to have the full Overdraft Privilege limit reinstated, if the overdraft limit was not permanently revoked as a condition of the extended repayment plan.
  • When a member exceeds their Overdraft Privilege Limit of $750, it is Members First’s policy to not permit further overdrafts. Under certain emergency situations (technical problems, inclement weather), Members First reserves the right to make exceptions to this Policy.

Understanding Program Notifications

  • Upon each occurrence of an overdraft, Members First will notify the member by mailed notices of their negative balance on the account and all fees assessed.
  • The Overdraft Privilege program will generate letters to the members the first time they use the service, when an account has been consistently negative for 10, 20, and 32 days.
  • Members First will endeavor to identify “heavy users” of the program, and contact them to see if they qualify for any other available program or solution better suited to their needs.

Understanding Program Default

  • If the account is not brought current within the required timeframe, it will be charged off at the 45th day or shortly thereafter, not exceeding 60 days, if deemed to be uncollectable.
  • In some cases, Members First may allow a member to cover an overdraft through an extended repayment plan when the member is unable to bring the account to a positive balance within the required timeframe. The existence of the repayment plan, however, would not extend the charge-off determination period beyond the 60 days as measured from the date of the overdraft. Any payments received after the account is charged-off will be posted to the appropriate general ledger accounts.
  • If you enter into an extended repayment plan and you default on that plan, Members First reserves the right to make any and all owed balances due upon demand.
